📢 STOP PRESS! 📢 The Workers (Predictable Terms and Conditions) Act 2023 has been shelved! The legislation, which was to give workers the right to request a predictable working pattern, had been passed under the previous Conservative government, and was expected to come into force this September. However, the Department of Business and Trade has said that, while they are committed to introducing the right to a contract which reflects the number of hours regularly worked as part of their overhaul of workplace rights, they did not want to confuse employers and workers with two different models, and so have no plans to bring this Act into force. It is now expected that a version of this right will form part of the forthcoming Employment Rights Bill. #employmentlaw #employmentlawupdates #labourgovernment #HRadvice #UKparliament

The business lobby is demanding that small businesses be redefined as businesses of up to 25 employees – an increase from 15. This will translate to tens of thousands more workers losing valuable protections – including a reduction in their rights to challenge unfair dismissals. Calling worker protections ‘red tape’ and going after workers’ rights by stealth like this is simply not on. As the election draws nearer, Peter Dutton and the Coalition need to rule out making any such changes if elected.

The FTC and DOJ recently released antitrust guidelines addressing business practices that could harm competition and restrict worker mobility. Employers should pay close attention to the following areas: 📉 Wage-Fixing: Agreements to standardize employee pay across companies can violate antitrust laws. 🤝 No-Poach Agreements: Pacts to avoid hiring or recruiting each other’s employees are under scrutiny. 🚫 Overreaching Non-Competes: Restrictions that unreasonably limit employee opportunities may face challenges. 🔗 Information Sharing: Exchanging salary or benefits data with competitors could be seen as an attempt to coordinate compensation. 🛑 Collective Boycotts: Joint refusals to engage with certain workers or labor groups may raise red flags. While these guidelines reflect a push to protect workers and promote fair competition, they may be short-lived. Dissenting statements from FTC commissioners suggest potential revisions or reversals under the Trump administration.
