Did you know that “compulsory” counterclaims are not absolutely compulsory? I did not, and apparently I was in good company. Former Florida Supreme Court Chief Justice Stephen H. Grimes, when sitting as the Chief Justice of the Second DCA, framed the question as follows: “May a party who has failed to interpose a compulsory counterclaim in a suit which is still pending bring an independent action on the same claim? 𝐒𝐮𝐫𝐩𝐫𝐢𝐬𝐢𝐧𝐠𝐥𝐲, 𝐭𝐡𝐞 𝐚𝐧𝐬𝐰𝐞𝐫 𝐬𝐞𝐞𝐦𝐬 𝐭𝐨 𝐛𝐞 𝐲𝐞𝐬.” Cheezem Dev. Corp. v. Maddox Roof Serv., Inc., 362 So.3d 99 (Fla. 2nd DCA 1978)(emphasis added). Although Rule 1.170(a), Fla.R.Civ.P., mandates that an answer “must state as a counterclaim any claim” the pleader has against the opposing party arising out of the same transaction or occurrence, the Cheezem court held that such “compulsory” counterclaim can be filed in an independent action if the main action has not already reached a judgment. Cheezem, 362 So.2d at 100-101. Similarly, multiple courts have held that it is an abuse of discretion to deny leave to file a compulsory counterclaim. E.g., Branscomb v. Ploof Truck Lines, Inc., 454 So.2d 59 (Fla. 5th DCA 1984); Asgaard Fund, L.P., v. MM80 Oceanside Holdings, LLC, 335 So.3d 1233 (Fla. 3d DCA 2021).   Like what you see?
