Today, the US Environmental Protection Agency (EPA) announced the final National Primary Drinking Water Regulation for six PFAS, establishing Maximum Contaminant Levels and aiming to prevent PFAS exposure in drinking water for around 100 million people. This regulation was informed by over 120,000 public comments, consultations, and stakeholder engagement, and is supported by $1 billion from the Bipartisan Infrastructure Law to aid in PFAS testing and treatment. The rule mandates public water systems to monitor these PFAS by 2027, enforce reductions by 2029 if levels exceed MCLs, and keep the public informed. This is a great step in the effort to reduce PFAS contamination and protect public health!

In 2021, the U.S. Environmental Protection Agency (EPA) initiated its "PFAS Strategic Roadmap" to comprehensively address the contamination of drinking water by certain per- and polyfluoroalkyl substances (PFAS). As part of its strategy, last week the EPA issued the final National Primary Drinking Water Regulation, setting legally enforceable drinking water levels, called Maximum Contaminant Levels, for six PFAS. Public water utilities in the US are facing a 5-year deadline to meet low parts-per-trillion limits for six per- and polyfluoroalkyl substances (#PFAS) in drinking water. The Environmental Protection Agency estimates that thousands of water systems will need to install advanced treatment processes to meet the limits.

The federal government recently set strict limits on PFAS in drinking water. Meanwhile, Wisconsin lawmakers disagree over solutions, leaving millions of dollars for remediation in limbo. Communities like Peshtigo and Wausau remain affected. Center for Water Policy researchers, Andrian Lee and Melissa Scanlan conducted a legal analysis on PFAS contamination in Wisconsin's drinking water. In this policy brief, Lee and Scanlan discuss primacy, which grants the Environmental Protection Agency primary enforcement responsibility for public water systems. Delegating available funds to address PFAS is critical to adopting new primacy programs to remain in compliance with the EPA's new PFAS contamination benchmark.
