Urgent Call to Action: Tell Senate Leadership to Support S. 1430 for PFAS Liability Protection I sent my letters to Senator Wyden and Senator Merkley last night. This is NACWA's top priority and if you get a water or sewer bill this concerns you and what you will be asked to pay in the future. EPA's proposed designation of PFOA and PFOS as hazardous substances under CERCLA without liability protection for water systems - which could be finalized this spring - presents a daunting challenge for our sector, potentially placing the financial burden of environmental cleanup on utilities and their ratepayers, rather than on the polluters responsible for the contamination. This move could significantly impact our ability to provide affordable clean water services. The introduction of S. 1430, the Water Systems PFAS Liability Protection Act, by Sen. Cynthia Lummis, is a beacon of hope. This pivotal legislation aims to preserve the essential "polluter pays" principle of CERCLA, ensuring that water utilities are shielded from CERCLA liability for PFAS. By supporting S. 1430, we can protect water systems from undue liability and continue our mission of delivering clean water services without the looming threat of PFAS litigation.

Insurers beware---Superfund is baaack! On April 19 the EPA designated the two most prevalent PFAS compounds as hazardous materials under CERCLA (Comprehensive Environmental Response, Compensation and Liability Act, better known as Superfund). This makes it easier for the EPA to force polluters to clean up sites, but it also raises complicated issues about determining who is responsible. This action was not a surprise as the agency originally laid out this plan in its “2021 PFAS Strategic Roadmap.” This was the agency’s second recent PFAS action as on April 10 it established the first Federal drinking water standard. Once a chemical is listed as a “hazardous substance,” the EPA has the authority to order potentially responsible parties to clean up contaminated sites with the cost is being borne by those deemed liable. As an alternative, the EPA can clean up the site and seek reimbursement from those deemed responsible. These can be current or former owners or operators of a site. Because the liability is joint and several even those with minimal involvement can be held fully responsible. We presume most insurers have had PFAS on their radar screens for some time and have been analyzing their potential involvement. As insurers have learned from prior Superfund experiences, the designation of an entity as a potentially responsible party generates considerable uncertainty regarding the apportionment of costs. Expect a new wave of litigation and claims. #insurance#PFAS#EPA

A house companion bill was introduced that protects public and private #water and #wastewater utilities from #CERCLA liabilities due to #PFAS. This also includes protections for private contractors performing disposal on behalf of the utility. ICYMI, one of nearly two dozen chemical companies that have faced lawsuits brought by water systems over PFAS pollution in litigation centralized in a South Carolina federal court, BASF reached a $316.5 million settlement with U.S. public water systems for water supplies contaminated with PFAS substances in firefighting foam. The BASF settlement money will help cities, towns, and other public water systems remediate contamination. BASF will pay about $4 million in July 2024 and another $312.5 million in March 2025. BASF said the settlement does not constitute an admission of liability or wrongdoing. BASF will seek to recover the settlement costs through numerous insurance policies. BASF was tentatively scheduled for trial in early 2025 with six other companies, including 3M, Chemours, Corteva, and DuPont de Nemours. In April, Johnson Controls unit Tyco Fire Products agreed to a $750 million settlement. Beyond the courtroom, PFAS are under increased regulatory scrutiny in the United States. In 2023, PFAS pollution lawsuits over groundwater contaminated with PFAS sprayed in firefighting foams at firehouses and airports across the U.S. led to more than $11 billion in settlements.
