"A federal judge in New York ruled that Customs and Border Protection (CBP) can’t search travelers’ phones without a warrant. The ruling theoretically applies to land borders, seaports, and airports — but in practice, it only applies to New York’s Eastern District. That’s not nothing, though, since the district includes John F. Kennedy Airport in Queens, the sixth-busiest airport in the country. 🚨 Myth vs. Fact: Warrant Exceptions 🚨 Did you know there are several exceptions when a law enforcement officer can conduct searches or seizures without obtaining a warrant? Here is a breakdown of some common exceptions recognized under United States law: ➡ Exigent Circumstances: This exception allows law enforcement to conduct a search or seizure without a warrant if there's an immediate threat to safety or if there's a risk that evidence will be destroyed or removed. Examples include the hot pursuit of a suspect or when there's a risk of imminent harm. ➡ Consent: If an individual voluntarily consents to a search, law enforcement can proceed without a warrant. However, consent must be freely given and not the result of coercion or duress. ➡ Search Incident to Arrest: In an incident involving a lawful arrest, law enforcement officers can conduct a warrantless search of the person and the area within their immediate control to ensure officer safety and to prevent the destruction of evidence. ➡ Automobile Exception: Recognizing the reduced expectation of privacy in vehicles, law enforcement can search a vehicle without a warrant if they have probable cause to believe it contains evidence of a crime such as a positive alert from a K9 “free air sniff”. ➡ Plain View Doctrine: If law enforcement officers are lawfully present in a location and discover evidence of a crime that is in plain view, they can seize it without a warrant. ➡ Stop and Frisk: In certain circumstances, law enforcement officers may conduct a brief, warrantless pat-down search of a person's outer clothing if they have reasonable suspicion that the person is armed and dangerous. This is sometimes called a “Terry Stop” based on the Supreme Court case “Terry v. Ohio.” ➡ Border and Airport Searches: At international borders and airports, customs and border protection officers have broader authority to conduct searches without a warrant, including searches of luggage, vehicles, and persons, to enforce immigration and customs laws. #lawenforcement #knowyourrights #warrantexceptions #warrants #ewarrants

*DATA PRIVACY CONCERNS FOR TRANSFEREES ADDRESSED* Some great news on a longtime issue- currently a relocating transferee's information is made publicly available via the shipping manifest for their household goods coming into the US. The International Association of Movers (IAM), Worldwide ERC® and the Moving & Storage Conference of the American Trucking Associations have been collectively pushing for legislation that would require U.S. Customs and Border Protection to remove all personally identifiable information #PII from cargo manifests before making that information public. This morning IAM announced that this legislation has been passed and is closer than ever to becoming a reality. The next steps are final signing by the Senate and then off to President Biden.
