Mark Zuckerberg on Fair Use Doctrine: "I think that in any new medium in technology, there are the concepts around fair use and where the boundary is between what you have control over. When you put something out in the world, to what degree do you still get to control it and own it and license it? I think that all these things are basically going to need to get relitigated and rediscussed in the AI era."

Why is Zuck intentionally bullshitting about IP law he knows? Because it is useful from a corporate perspective. Fair Use does not allow unlimited commercial exploitation.
Fair Use Doctrine was set up to build off of English Common Law and the Nww England notion of The Public Commons. Fair Use Doctrine is a notion that discourse, journalism, satire, and education can use existing private resources and copyright for interaction for the public good. This DOES NOT create a loophole for unlimited corporate exploitation.
The history of Public Commons in New England includes their use for grazing, burial grounds, nightly animal storage, planting, execution, protest, and recreation. Public common land became public common intellectual discourse because the discourse started in the common land. Fair Use Doctrine is for PUBLIC COMMONS not private AI profit.
--Warhol v Goldsmith: commercial exploitation and profit voids the use of fair use doctrine.

--Hachette v. Internet Archive: permission is required from copyright holders for digitization of materials.
-- UMG Recordings v. Internet Archive: will cement the inability to digitize without permission and licensing.
COPYRIGHT protects INDIVIDUAL AUTHORS to encourage them to make initial money off their work.

FAIR USE DOCTRINE ensures that material in the public discourse is in the public commons. From common land to common intellectual discourse. Not private AI tech profits.

Creators and publishers do not overestimate anything. US Copyright Law states that authors control their work thru copyright. Everyone values their own IP including Meta. Meta vigorously defends their IP. Does Zuck advocate that Meta become an anarcho-syndicalist open source collective? Or does Meta respect US copyright law they are legally bound to, and which they use to protect Meta, Facebook, Instagram, WhatsApp, & Oculus IP? Is Meta going open source all their IP and code? Or does Meta respect IP law? This question should be asked of ANY COMPANY using Gen AI.
The Verge: Mark Zuckerberg: creators and publishers ‘overestimate the value’ of their work for training AI. ‘If they demanded that we don’t use their content, then we just wouldn’t use their content.’
