How can a Goliath win in the court of public opinion? I was glad to have my recent presentation at the #MARQUES annual conference cited back to me following coverage of the Supreme Court judgment in the case of SkyKick UK Ltd. and another v. Sky Ltd. and others. The Financial Times described it as “a victory for David over Goliath in many ways”. Meanwhile, Alistair Osborne in The Times notes the familiarity of this case to the subject of a number of previous opinion columns covering trademark cases brought by EasyGroup, describing the legal tactic as “easyBullying”. My conference presentation, as summarised in WIPR - World IP Review, put forward three routes to winning hearts and minds in legal arguments: 1️⃣. Economic value – e.g. investment in a brand, underpinning a successful business and rewarding the risk taking journey along the way. 2️⃣. Consumer welfare – e.g. trust that comes from a recognisable brand and associated assurance for quality. 3️⃣. Treating David well – ensuring correspondence and conduct in litigation is mindful of the media spotlight and reputational risk at each juncture. That’s the broad route to match a win in the court of law with a win in the court of public opinion. But here’s the killer question – in these David v Goliath battles, can a Goliath lose in the court of law but still win in the court of public opinion?
