Hello #connections, Sharing insights on a significant judgment related to the Employees' Provident Fund Act, 1952 in the case of "Pawan Hans Limited And Others Vs Aviation Karamchari Sanghatan" (Civil Appeal No.353 of 2020). Pawan Hans Limited, a company with 51% Government of India ownership, had 840 employees, including 270 on a contractual basis. Despite the broad definition of 'employee' in the PF Trust regulations, the company only applied them to regular employees, claiming exemption under section 16 of the EPF Act. The Central Government's 2001 notification included "an establishment of aircraft or airlines other than those owned or controlled by the Central or State Government." The union sought benefits for contractual employees, leading to a High Court ruling directing the company to enroll them under the EPF Act.
