I enjoyed digging into this fascinating D.C. Circuit case with potential implications for RTOs, climate groups, and FERC practitioners writ large. Jennifer Fischell and I are looking forward to discussing these (and many more!) issues at the Energy Bar Association Annual Meeting later this week!
The D.C. Circuit is poised to decide important questions about how the energy industry may respond to climate-change regulations and what FERC must consider when reviewing proposed changes to the energy markets. ML’s Jennifer Fischell and Jackson Myers discuss the anticipated decision in New York State Public Service Commission v. FERC in an article published by RTO Insider. Implementing U.S. grid upgrades is a long and costly process, yet we are optimistic that regulators are now taking material steps to address this issue. Funding opportunities from the Federal Energy Regulatory Commission (FERC) and Department of Energy (DoE) promise incremental gains. In our latest report, Unlocking U.S. Transmission Upgrades – Are We On the Cusp of Real Progress?, legal experts at Troutman Pepper examine the regulatory changes that could signal substantial progress. FERC is seeking to increase certainty for transmission planners and has begun to engage with state policymakers and regulators. This aligns with the efforts of the Federal Government to boost FERC’s leadership role. The DoE is supporting legislative efforts to provide a framework to stimulate multi-agency coordination through programs, initiatives, and grants. Yesterday's Federal Energy Regulatory Commission nomination hearing with the U.S. Senate Committee on Energy & Natural Resources underscores the urgent need for holistic power system planning. EPSA President & CEO Todd Snitchler states, "FERC needs to focus on its authority as an economic regulator that ensures a reliable electric and gas system. We need a Commission laser focused on the reality of system operations and the growing delta between aspirational goals and operational realities. These nominees signaled they understand and support that priority.” Read more in our press release: https://lnkd.in/eUc9kyFH #FERCnominees #FERC #reliability #energyexpansion

White smoke ! The European Council and European Parliament have reached a provisional political agreement on changes to the Gas Directive and Gas Regulation, establishing common EU rules on how methane and hydrogen markets should be organised. During the legislative process, we have been active, together with colleagues from across our offices, in advising a range of clients on the potential options for reform and their potential impacts. Click here for an overview of key features: and references to four studies, on which Frontier either led or played a major role for the Commission. https://okt.to/0CFTeP #EU #EnergyRegulation #hydrogen

On August 9, 2024, the Federal Energy Regulatory Commission (FERC) received a request from the Alliance for Tribal Clean Energy (ATCE) to consider removing certain financial obligations in Order No. 2023 that ATCE sees as obstacles to Tribal clean energy development. ATCE asked FERC to review the financial requirements that Tribal Nations must meet to interconnect power plants to the electric grid, specifically with FERC’s commercial readiness deposit and withdrawal penalty framework in Order No. 2023. In response, FERC has issued a Notice of Petition for Rulemaking and Intent to Hold Tribal Consultation Meetings in FERC Docket No. RM24-9-000 in eLibrary: https://lnkd.in/eGpqRANy FERC is seeking input and feedback from the public about the petition for the next 60 days. Comments on the petition are due November 4, 2024 by 5:00 p.m. EDT. Public comments are a crucial part of FERC’s review processes and provide key information about community, local, and individual concerns. To learn more about the petition and how to comment, contact FERC’s Office of Public Participation by phone at 202-502-6595 or email at OPP@ferc.gov.
