What about United utilities who have been illegally dumping sewage in our lakes rivers and seas for some time now, where’s the equivalent penalty for them where is the equality? Tough and decisive, don’t make me laugh!
Whilst it's good that the culprits have been caught and punished - although no mention of a POCA - there never seems to be duty of care consequences back up the chain. The 26k tonnes must have come from legitimate waste facilities - the photo shows some of the 5k tonnes dumped at a disused factory in the Midlands in 2016 - and yet no mention of related enforcement action.

Yet again the fines are tiny compared to the crims profits and the land owners costs. £10k is a couple of decimal points out in my eyes. Will there be a profits from crime seizure as well ?

Irresponsible actors not only harm the environment but also tarnish the reputation of the entire industry. Speaking as an individual passionate about sustainability and transparency in waste management, I believe prevention must be the priority. Strengthening traceability systems, streamlining reporting processes, and ensuring enforcement agencies have sufficient resources are essential steps to stopping such practices at their source. I hope this case acts as a wake-up call for meaningful action to protect both the environment and the integrity of our sector.
The Courts are bound to follow the Environmental Sentencing guidelines when sentencing this type of offence. Based on the press release I suspect that the Defendants were sentenced on the basis that the offending was deliberate and a Category 2 Harm (significant adverse effect or damage to air or water quality, amenity value, or property). Previous offending and multiple offences are likely to push sentencing towards the top of the sentencing range. The cap for this offence is 2 years.
