Interesting to look at some of the data from AFCA's annual report - and the major reasons for advice complaints. Inappropriate advice at the no.1 cause is important to note - as the language is instructive. s961G of the corporations act references that advice must be 'appropriate' once the s961B safe harbor provisions are met. Appropriate is of course an interesting one because it's not the 'best', or the cheapest, most comprehensive or any other objective metric - it's advice that is appropriate to the individual circumstances of the client. The best way to demonstrate appropriateness? ✅ Good qualitative questions to understand personal drivers ✅ Quality file notes linking advice to personal circumstances ✅ Demonstrating client understanding of how advice meets their needs ✅ Demonstrating how recommendation fits the context of the clients broader life/objectives. 🚀 New Code of Conduct for Directors! 🚀 On 6th June 2024, the Institute of Directors (IoD) unveiled a groundbreaking consultation paper on a new Code of Conduct for directors. This code is designed to guide directors across all sectors – private, public, and not-for-profit – towards making better decisions and upholding the highest standards of integrity. Here are the six core principles shaping this code: ♦ Leading by Example: Setting exemplary standards in personal conduct and decision-making. ♦ Integrity: Acting with honesty and adhering to strong ethical values. ♦Transparency: Making decisions openly, honestly, and clearly. ♦Accountability: Taking personal responsibility for actions and their consequences. ♦Fairness: Treating everyone equitably, without discrimination or bias. ♦Responsible Business: Integrating ethical and sustainable practices into all business decisions, considering societal and environmental impacts. The IoD is actively seeking feedback on any additional issues to address in this code and ideas for strategies to raise awareness among directors and the public and to what extent government, regulators or professional bodies should be monitoring or regulating the code.
