A not-too-surprising outcome from the District of Delaware (h/t Andrew Russell) disposing a long-stayed case without prejudice (over the protestations of the defendant). But I take a slight issue with Judge Hall's conclusion that the defendant could have asked the ITC for relief to compensate it for the millions of dollars in fees/costs it spent defending the ITC action. While the defendant could (and in fact did) ask the ITC to impose sanctions, that's a very high bar -- and there's no ITC analog to Section 285 to award costs/fees to a prevailing party, even in what might otherwise be an exceptional case.
