‘Working closely with our partners and academics Essex Police has made a number of positive changes to the Clares Law, Domestic Violence Disclosure Scheme. ‘Leading to approximately 50% more applications in 2024 than 2022, and over 1000 more applications authorised, meaning 1000 more persons at risk have been advised of a potential danger and now place safeguards or seek support, than 2022’ Says Detective Inspector Jamie Stirland, who works in the Domestic Abuse Review Team (DART). DART is a new team consisting of 20 officers, like DI Stirland, focusing on Clare's Law disclosures and ensuring the people of Essex remain safe, supported and informed of potential risks. As advocates, our duty to the court requires us to not knowingly cause or allow the court to fall into error. This extends to exhibits tendered, as the court will or may rely on them when coming to a decision. When you tender a document in court, you must take reasonable steps to satisfy yourself of the origins of the document and to ensure that the contents are accurate. If your client is charged with a fruad or dishonesty offence - check every single document very carefully! Call every author and check the version of the document you have is the one they provided. If you have filed a document in advance of the hearing and later become aware of something you don’t feel comfortable with, you can advise the court that you no longer seek to rely on the material and ask that it be removed from the tender bundle. What happens next remains to be seen, but you will be in a whole lot more trouble if a forged document is later identified and you knowingly tendered it or ignored it when it didn’t pass the sniff test. I know nothing more about the below case than what is in the press release. What matters is that it is a sage reminder of our obligations to the court and that non-compliance can potentially have criminal consequences. #law #courts #lawyers #ethics #police https://lnkd.in/gvD_CUyR

As of July 1st, 2024, the Crimes Legislation Amendment (Coercive Control) Act 2022 (NSW) officially took effect. This legislation marks a significant milestone, by introducing a specific offence of coercive control. The new law defines coercive control as a pattern of abusive behaviours aimed at coercing or controlling a current or former partner. Abusive behaviour includes violence, threats, intimidation, and actions intended to dominate or regulate the victim’s life. Importantly, the law considers the cumulative impact of repeated or continuous abusive actions rather than isolated incidents. The courts will now review the history of a relationship to determine if a course of conduct to coerce or control has occurred. Evidence must show more than a single threatening text or email to establish such a pattern. If convicted of this offence, the maximum penalty is seven years imprisonment. In a compelling session with the Institute of Directors, FCJ’s Executive Director, Seema Kennedy OBE, shed light on the pressing issues facing UK businesses due to the surge in litigation and unregulated third party litigation funding. The panel discussed the concerning trend of increased litigation against company directors. This rise is closely linked to the proliferation of unregulated litigation funding, which has lowered the barrier to initiating legal proceedings, thereby exposing directors to heightened legal risks. No business is immune to the ramifications of this litigation wave. The financial and reputational stakes involved are placing an undue burden on businesses, potentially stifling innovation and affecting the overall investment climate in the UK. The timing couldn’t be more pertinent as the Civil Justice Council (CJC) has just published its Terms of Reference for a comprehensive review into the third party litigation funding industry.
