Reasonable accommodations imply the existence of... well, UNreasonable accommodations. During Tuesday's webinar, Melanie Naranjo opened things up by asking Justine L. Abrams, Esq. of Ogletree Deakins a simple question: is #HR required to approve *every* accommodation request that comes across their desk? "There are 3 reasons why the answer to that question is no," says Justine. And one reason is that the accommodation request is unreasonable. 💡 In order for an accommodation to be considered reasonable, it must be: • Reasonable on its face: meaning doable, feasible, or plausible • Effective: meets the needs of the individual by providing them the help that their disability causes them to need #reasonableaccommodations #hrcommunity #humanresources

Accommodation requests were up again this past year, according to Littler's Annual Employer Survey Report which was released last week. 📈 95% of the respondents reported an increase in accommodation requests over the past year 📈 74% of respondents reported an increase in mental health-related accommodations in the past year What does this tell us? 🧠 Employees are becoming more willing to disclose psychological conditions and neurodiversities 💭 Employees are becoming more familiar with the accommodation request process FYI, If you're thinking "we don't have that many people with disabilities at our company" or "we're just not seeing many accommodation requests", it's probably a sign that employees aren't feeling comfortable/safe asking for support, or are unaware of how to even go about asking. 🚩 #ADA #Accommodations #Littler #Law #Legal #EEOC #Disability #DisabilityInclusion #Disclosure #SelfID #DEI #HR #HumanResources Image description: Red background with black and white text reading: "95% of employers reported an increase in accommodation requests over the past year" followed by the source "The Littler® Annual Employer Survey Report | 2024"

In the realm of #employment, the duty to #accommodate is a fundamental principle that ensures inclusivity and equality in the workplace. It's about modifying the work environment and practices to enable employees with disabilities to perform their job functions effectively. Accommodation can take many forms, from providing specialized equipment for those with visual impairments to flexible work schedules for individuals with medical appointments. It's about creating a workplace where diversity is not just accepted but embraced, allowing every employee to contribute to their fullest potential. However, this duty has its limits, known as 'undue hardship.' Employers are not required to make accommodations that impose excessive costs or create substantial health and safety risks. It's a delicate balance between the rights of the individual and the operational capabilities of the employer. Did you know that the U.S. Department of Labor’s Job Accommodation Network (JAN) recently shared some fascinating insights about how workplace accommodations can make a real difference for people with disabilities? According to JAN's survey, most accommodations don't break the bank (in fact, over half of them cost nothing at all to put in place!) and they bring a host of benefits for employees and employers alike. It's pretty cool to see how something as simple as a small adjustment can make such a big impact, right? I invite you to read more about #WorkplaceAccessibility here: https://lnkd.in/eQYZJEnG

#Reasonableaccommodation adaptations to a workplace, tasks or working conditions to enable a person to do their job with fewer barrier -is already guaranteed in EU law thanks to the Employment Equality Directive from 2000. However, the understanding of what reasonable is and how to provide it is generally lacking across the EU. This means that persons with #disabilities are too often denied their right to reasonable accommodation at work. #inclusion
