The Fair Work Commission has made orders requiring an employer to implement a flexible work arrangement (FWA) request that would allow one of its employees to work from home. These are the first orders that have been made by the Commission that have required an employer to implement a FWA following the new arbitration powers being inserted into the Fair Work Act 2009 (Cth) on 6 June 2023. Deputy President Lake ordered that for a three month period FedEx must allow one of its employees to work from home for three out of his four work days. The FWA was made on the basis of the employees’ caring responsibilities for his wife and child, which DP Lake found constituted a valid jurisdictional basis to make a FWA. Interestingly, the employee in this case refused each of the alternative FWA offers that had been made to him by FedEx throughout the FWA request and conciliation process that did not allow him to work fully from home. He also refused to discuss the FWA request with his manager and requested that all communications be provided to him in writing. The Commission further found that the employee had a lower output than his colleagues and that his performance could improve through in-person office attendance. While acknowledging the benefits of in-person office attendance, such as the positive aspects of employee interaction and collaboration on performance improvement, DP Lake rejected FedEx’s argument that it had reasonable business grounds to refuse the employee’s FWA request. FedEx had contended that allowing the employee to work from home on a full-time basis would result in a “significant loss in efficiency or productivity”. DP Lake found that if FedEx (or any employer) wanted to rely on this ground to refuse a FWA request that this claim would need to be substantiated and that “[g]eneric and blanket HR answers are not sufficient alone to establish a reasonable business ground for refusing a request”. The Commission’s decision in this regard provides useful guidance for employers when considering an employee’s FWA request and confirms that detailed evidence should be provided to support any refusal of a FWA request on the reasonable business ground exception.
