Using someone's trade mark, patent, copyright, plant breeder’s right or design without their permission is known as IP infringement and can become costly. -Someone infringing on your IP Your IP rights may be infringed when your work, protected by IP laws, is used, copied or mistreated without your permission. To take legal action, you'll need to prove that: -the infringer has copied whole or part of your work -your IP rights exist -the infringer did not have permission or consent to copy your work.

The Commission after careful consideration of the definition of 'Intellectual Property " as give below: Documented or undocumented knowledge, creative ideas, or expressions of human mind that have commercial (monetary) value and are protectable under copyright, patent, servicemark, trademark, or trade secret laws from imitation, infringement, and dilution. Intellectual property includes brand names, discoveries, formulas, inventions, know how, registered designs, software, and works of artistic, literary, or musical nature. is of the opinion that the questions set by examiners for the exam can by no stretch of imagination be considered as 'Intellectual property" since the criteria stipulated for the same are seen to be irrelevant in the case of questions set for an exam as they are not protected under copyright, patent or trade secret laws. Hence the Respondent's argument that the information sought includes intellectual property is set aside as it is see to be having no merit. Bulgaria adopts EU law giving publishers neighbouring rights over publications. Following the transposition of the DSM Directive (EU) 2019/ 790 into an amendment to the Bulgarian Copyright and Neighbouring Rights Act, press publishers (i.e. news publishers and agencies) are now granted neighbouring rights to authorise, prohibit, and make their publications available to the public via online use by information society service providers.
