On January 16, 2025, the US Department of Commerce’s Bureau of Industry and Security (BIS) published a final rule aimed at addressing national security concerns related to passenger vehicles sold or imported into the United States. Here are three key takeaways from this new regulation: - National Security Measures: The rule aims to mitigate national security risks by prohibiting the sale or import of passenger vehicles with certain hardware or software from entities associated with Russia or China. - Compliance Requirements: The rule applies to certain Vehicle Connectivity System (VCS) hardware and software, and to certain Automated Driving System (ADS) software, requiring a Declaration of Conformity, General Authorization, or Specific Authorization for vehicles under 10,001 lbs. - Implementation and Impact: The rule affects OEMs and their suppliers, with software prohibitions starting in 2027 and hardware prohibitions in 2030. It includes provisions for legacy software and hardware repairs, and may lead to relocation of manufacturing operations.
