SCOTUS reshaping the power of federal agencies. Good, bad, or ugly? -Majority opinion: Chevron was a flawed two-step that tied judges’ hands and forced them to rule against their expertise, and against the sense of the APA (Administrative Procedure Act). - Minority opinion: Chevron is the backbone of administrative law, and Congress expects its agencies to carry out its will. The agency is made up of experts in their field, who can resolve ambiguities in Congressional directives. But do experts always retain the ability to both create and levy heavy fines against those who disagree with their expert opinions? I am looking forward to reading more on Loper Bright v Raimondo. A little leveling of the playing field, some disruption of the status quo. Aren’t those principles promoted as good and necessary?

Beginning on January 22, 2024, in compliance with President Biden’s February 4, 2022 Executive Order, 14603, federal construction projects with a total estimated cost of $35 million are required to utilize a project labor agreement (“PLA”) unless the contracting agency grants an exception. The Federal Register estimates that this rule will impact approximately 119 IDIQ contracts each year; these contracts have an average award value of about $114 million. ABC estimates that President Biden's pro-PLA policy will have a significant impact on federal construction contracts across America. At least 180 federal construction contracts worth $16 billion annually will be affected. This includes several contracts for projects in Jacksonville and dozens of projects in Florida and the Southeast. Associated Builders and Contractors and its Florida First Coast chapter have filed a lawsuit against the anti-competitive project labor agreement rule for federal construction projects. Effective January 22, 2024, the Federal Government is requiring the use of project labor agreements (PLAs) for all large-scale Federal construction projects for the General Service Administration, Department of Defense, and NASA, where the total estimated cost to the Government is $35 million or more, unless an exception applies. A PLA is a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project. The rule requires that the prime contractor negotiate a PLA that all subcontractors are required to sign. The rule does not require that contractors and subcontractors join labor unions. Exceptions include when the requirement for a PLA would not advance the Federal Government's interests; where market research indicates a substantial reduction in competition to such a degree that adequate competition at a fair and reasonable price could not be achieved; or where the requirement would be inconsistent with other statutes, regulations, Executive Orders, or Presidential memoranda. Steven Mann Funny how half a dozen other states can utilize the IIJA funding to spearhead much needed infrastructure projects and outside of the IIJA such states as MA can perform mega much-needed infrastructure projects such as Boston's Big Dig where they burried the highway for a greenbelt through the city center and yet.... NJ can't get a high-speed rail from Secaucus to Atlantic City... and that could just be the first leg of what could be the interstate DC to Boston multi state collaborative build for a highspeed rail that could even reach far beyond... Think about...The housing and employment opportunities to come online in AC, the insurgence of private capital to the various markets, the reduced VMTs and congestion that New Jersey has come to love, climate change and the green initiative undertone to this, the progressive buzz words for inclusionary and equitable development practices and policy agendas, I mean just fill in the blanks as you please... and yet NJ adds more and more red tape on re/development knowingly or unknowingly, as it claims to be moving forward on various fronts all while demanding more from municipalities who as you know, are competing against one another while the state as whole competes with new emerging markets that are set at a better price point, greater employment opportunities and improved quality of life... So what's the take on this, let's just keep watching the casino bankruptcies trade hands, tax payer bailouts and as we sit here wondering why such keystone cities in our state can only produce paper development, let's all take note... there's no liquidity in the market for backing the much needed re/development demand that our old state desperately needs and these secondary markets are left to rot. WHERE'S NJ'S BIG P3 PLAY ON THE IIJA?? Politics as usual..
