Empowering LGBTQI+ Workers: 7 Key Workplace Protections and Resources In today’s diverse workforce, the U.S. Department of Labor is a committed advocate for the rights of LGBTQI+ workers. It’s not just about following the law; it's about doing what's right. We ensure that every workplace is a haven of safety and respect, welcoming individuals across the full spectrum of sexual orientation and gender identity. The march toward equality in the workplace has been long and challenging. From the Stonewall uprising to landmark Supreme Court rulings, each step has been a stride toward justice. We are proud to support policies that allow people to be fully themselves at work, and over time our policies have evolved to meet the growing demands for inclusivity. Our protective policies and resourcesFamily and Medical Leave Act (FMLA) provisions: We ensure LGBTQI+ workers’ rights to unpaid, job-protected FMLA leave for family-related reasons, including caring for a same-sex spouse or their child.Guidance on "spouse" and "marriage" definitions: Under the Employee Retirement Income Security Act of 1974 (ERISA), we provide clarity on recognizing same-sex marriages and spousal benefits to help eliminate discrimination and ensure equality in retirement benefits.Restroom access guide for transgender workers: Our Occupational Safety and Health Administration offers practical advice for employers to create inclusive facilities.Enforcing nondiscrimination protections: Our Office of Federal Contract Compliance Programs monitors businesses with federal contracts to prevent the misuse of funds for LGBTQI+ discrimination.Job Corps program inclusivity: We guarantee equal access for transgender applicants and students.Discrimination prohibitions: These orders prohibit discrimination based on gender identity or sexual orientation, ensuring equal opportunity in federal employment and military service.Mental health support insights: We provide guidance on offering comprehensive mental health support for LGBTQI+ workers.By integrating these policies and resources, we not only safeguard the rights of LGBTQI+ individuals in the workplace but also empower these workers and their employers to foster workplaces where everyone can thrive. This holistic approach ensures that the principles of equality are woven into the fabric of our nation’s labor practices. ACCESSIBLE WORKPLACE: As an employer, you need to create a workplace that is accessible and inclusive to all employees, including those with disabilities. The Equality Act 2010, requires employers to make reasonable adjustments. They need to ensure that employees with disabilities are not placed at a disadvantage. However, there may be instances where an employer cannot make a reasonable adjustment. Our Director Leanne Fitzmaurice answers two crucial questions on this subject. ❓ What is a reasonable adjustment? “A reasonable adjustment is a change or adaptation made by an employer to remove or reduce any disadvantage faced by a disabled employee. The adjustment should enable the employee to perform their role to the best of their ability. Employees should be treated fairly and equally to their non-disabled colleagues. Reasonable adjustments can be made to the workplace, working arrangements, or any other aspect of employment.” ❓ What if an employer is not able to make a reasonable adjustment? “There may be instances where an employer cannot make a reasonable adjustment. Reasons such as the adjustment being too costly, impractical or causing undue hardship to the business. In such cases, the employer should explore other options and discuss them with the employee. It is important to note that an employer must still comply with the law and consider alternative options to make reasonable adjustments.” Find out more: https://lnkd.in/e99NUfTk #hr #outsourcedhr #equality #reasonableadjustments #accessible #inclusive
