The IBA, established in 1947, has been instrumental in promoting legal standards globally, boasting a membership of over 80,000 international lawyers and 190 bar associations from 170+ countries. Since its inception in 2004, the #ConflictofInterest Guidelines have been pivotal in guiding legal professionals on identifying and addressing conflicts affecting arbitration impartiality and independence.
Notably, the 2024 revision introduces specific mentions of expert witnesses, reflecting the evolving landscape of arbitration practices. The 'traffic light' system, categorizing situations as 'red,' 'orange,' or 'green' based on conflict severity, remains a globally recognized method for assessment.
While voluntary, these #guidelines have garnered widespread acceptance within the international arbitration community.
