I am pleased to announce that together with my colleague Dr Asmaa Khadim, we are hosting a workshop at Erasmus School of Law on the 𝐄𝐦𝐞𝐫𝐠𝐢𝐧𝐠 𝐓𝐫𝐞𝐧𝐝𝐬 𝐢𝐧 𝐏𝐚𝐫𝐭𝐢𝐜𝐢𝐩𝐚𝐭𝐨𝐫𝐲 𝐉𝐮𝐬𝐭𝐢𝐜𝐞. The workshop will bring together scholars to discuss the institutional constraints on legal mobilisation, the forms of participation within the EU courts, and issues related to the standing and representation in courtrooms. In addition, the workshop will address various forms of participation in public interest litigation and the prosecution of environmental crimes, as well as the scope for participatory practices within the EU. The workshop will take place on 𝐓𝐡𝐮𝐫𝐬𝐝𝐚𝐲, 𝟔 𝐉𝐮𝐧𝐞 and registration is now open. Last month Georgina Reid and Reade Allison published a brief explanation of ethical negotiations of Indigenous Land Use Agreements, following a presentation to other native title lawyers. Although native title negotiations are much more than a 'check box' exercise, we developed a brief checklist to help parties take a snapshot of how their native title negotiations may be tracking. This checklist is amongst many other free resources to help parties navigate the native title system. Our resources are intended to be as user-friendly as possible. The UP Institute of International Legal Studies (IILS), the UP Law Center Information and Publication Division (IPD), and the British Institute of International and Comparative Law (BIICL), in partnership with the Commission on Human Rights (CHR) and the Asian Development Bank (ADB), are co-organizing a two-day Asian Regional Summit and Philippine National Conference on 08-09 July 2024 at the Malcolm Theater of the UP College of Law in Diliman, Quezon City. The conference will bring together judges, litigators, industry leaders, policymakers, scientists, and other experts to explore experiences, challenges, and opportunities in climate change litigation related to corporate behavior and its impact in the Philippines. I was crying on the train yesterday. I did not feel sad, weak, or in need of consolation. The tears appeared unbidden, as they often do, sent out by the part of me that resolves to remember something important in search of that part of me that pretends to forget, asking him to come home. The best answer to ‘why are you crying?’ is sometimes: “Because I’m human”, perhaps followed by: “Why aren’t *you* crying?” and then maybe a smile, but there is usually a precipitating factor. I had just watched a short clip about Tuesday’s verdict at the European Court of Human Rights (ECHR). This was a tempered triumph, because only one of three cases was deemed as admissible. *But* one showed proof of concept, *and* the court explained how to use human rights law to hold governments to better #climate policies. I was particularly moved by the moment when the young Sofia Oliveira from Portugal expressed her disappointment at not winning the case she had been part of for four years. I wanted to tell her: but you did win, and the feeling that accompanied the thought tipped me over the edge. Overall, then, this was by no means a failure, but I am reminded of Samuel Beckett: “Ever tried. Ever failed. No matter. Try again. Fail again. Fail better.” The real story here is the trying, and that’s what’s touching: that people do what they can with what they have, where they are. One of the things we can try is the law, and now we have a clearer sense of how to fail so much better that we might even begin to succeed. Of course, we should not over-rely on legal solutions to problems that are ultimately political or spiritual, but there is scope for legal imagination. Law may have become commercialised and technocratic, but the spirit of the law is ultimately a creative spirit, and it’s there to help us protect what we love. Roberto Mangabeira Unger puts it beautifully as follows: “The search for this latent and living law—not the law of prescriptive rules or of bureaucratic policies, but the elementary code of human interaction—has been the staple of the lawyer's art wherever this art was practiced with the most depth and skill. What united the great Islamic 'ulama', the Roman jurisconsults, and the English common lawyers was the sense they shared that the law, rather than being made chiefly by judges and princes, was already present in society itself. Throughout history there has been a bond between the legal profession and the search for an order inherent in social life. The existence of this bond suggests that the lawyer's insight, which preceded the advent of the legal order, can survive its decline.” More details and further reflections here:
