While serving as Judge Advocate at many courts-martial trials and in private practice, I discovered that most members of the Bar and some members of our appellate courts are yet to know the functions of principal members of courts-martial including the nature and number of offenses contained in some sections of the AFA. Certainly a court proceeding where neither the counsel nor the court understands the nature of the offense in a section of the AFA and the roles of every member of a court-martial would eventually produce a judgment equivalent to a guess work. "On 23rd October, 2023, a 5-member bench of the honourable Supreme Court of Pakistan announced its ‘short order’ in the case Jawad S. Khawaja and others versus the Federation of Pakistan and others in which it declared the trials of civilians by military courts ultra vires to the Constitution of the Islamic Republic of Pakistan, 1973. At the time of this writing, the detailed judgment containing the reasons based on which the Supreme Court reached this conclusion is yet to be released, however, we can try to fairly anticipate what will be contained in that detailed judgment." My thoughts, published in Courting The Law, about what I anticipate will be mentioned in the detailed judgment of the latest military courts case.

The daunting challenge for all of us is establishing a true democratic polity based on constitutional supremacy, rule of law and equity. The long periods of military rule, and experiments of “controlled democracy” and “hybrid regimes” in between have denied the people of their sovereign right of self-governance. A dictatorial, anti-people mindset prevails in all State organs. The post-election scenario in 2024 testifies to this grim reality. https://lnkd.in/d9s3cb_x

In Regimes Manipulated by the Military Establishment or DeepState, the Judiciary serves as a mere tool of Oppression. Judges, appointed for loyalty rather than integrity, enforce biased laws to suppress dissent and uphold the regime's authoritarian agenda. Constitutional protections are disregarded, and legal mechanisms are exploited to silence opposition. The judiciary's collusion with the ruling elite undermines democratic principles and erodes public trust in the legal system. In this environment, justice is sacrificed for the consolidation of power, perpetuating a cycle of impunity and oppression.
