Trade Policy Lawlessness Veiled in the Rule of Law U.S. policymakers portray the United States as the most open, transparent, rules-based economy in the world. Such moral preening is meant to excuse Washington's protectionism as exceptional and virtuous – trade restrictions imposed reluctantly and merely to level a proverbial playing field made unlevel by the actions of rule-breaking foreign companies and governments. But there is nothing virtuous about the biased, often capricious, and increasingly lawless administration of America’s so-called “unfair trade” laws.

Just over a week ago now, US Trade Representative Katherine Tai went through almost eight hours of hearings before the House Ways & Means Committee and then the Senate Finance Committee. The subject? The Biden Administration's Trade Policy Agenda. There's been a lot written about what was discussed already (for some good reading see https://lnkd.in/gYXW3mSU, https://lnkd.in/g4bTbptW, and https://lnkd.in/gXqHduD3). In my recent Trade Notes post I take a closer look at what USTR Tai said about digital trade. A quick summary: ➡ USTR Tai described the US's traditional approach to digital trade policy (and the rules on data flows/localisation and source code that the US walked away from last year) as "outdated" and "stuck in time". ➡There was a lukewarm defence of the WTO's moratorium on customs duties on electronic transmissions. ➡We got more detail on the motivation behind the US's policy shift on the data rules, including that it was driven by watching developments in Congress. ➡When pressed on the USTR's achievements on digital trade, the answer was "the progress that we are making is in advancing towards more updated proposals" - perhaps not the best place to be after three years in office.
