It's worth noting that while water descalers can help reduce limescale buildup, they do not remove minerals from the water as traditional water softeners do. Danish Supreme Court overturns judgement from the Eastern High Court: Deutz AG and DMN Found Guilty of Market Abuse and Anti-Competitive Practices Yesterday, the Danish Supreme Court ruled that the German engine manufacturer, Deutz AG (Deutz), and its Danish dealer, Diesel Motor Nordic A/S (DMN), had infringed the prohibition against anti-competitive agreements, and that Deutz had also itself infringed the prohibition of abuse of a dominant position. In 2013, the Danish Competition Council found that both provisions had been infringed by Deutz’ refusal to supply spare parts for DSB's train engines and via the agreements with DMN to prevent parallel imports and passive sales of said spare parts, thereby granting DMN absolute territorial protection. Upon appeal the Danish Maritime and Commercial Court first upheld the Danish Competition Council´s decision. However, in February 2023, the Eastern High Court annulled the Maritime and Commercial Court´s ruling and remitted the case to the Competition Council after citing inadequacies in the market definition that underpinned the decision. The Danish Supreme Court has now ruled that there was no basis for overturning the competition authorities' market definition and assessment of Deutz's market position. Contrary to the Eastern High Court, the Supreme Court considered that the Danish Competition Council was right to consider that Deutz had a 100% market share in the relevant market. As a result, Deutz possessed a dominant position, and the agreement was not covered by the vertical block exemption. Consequently, the Supreme Court upheld the Competition Council´s decision that Deutz and DMN had infringed the prohibition against anti-competitive agreements and that Deutz had infringed the prohibition against abuse of a dominant position. Notably, the European Commission requested to submit observations to the Supreme Court to ensure uniform application of competition rules across EU member states. This is the first time the European Commission has submitted observations in a competition case before a Danish court.
