Coach and its parent company, Tapestry, Inc., have filed a complaint against Gap, Inc. for trademark infringement, counterfeiting, unfair competition, and false designation of origin. The lawsuit claims that Gap, Inc. improperly used the word "COACH" on the front of their Old Navy brand t-shirts. True or False? Clients who own a trademark can stop anyone from using that name for any good or service. FALSE! There are many examples of the same mark co-existing for unrelated goods and services without any likely confusion. Both DOVE soap and DOVE chocolates are registered trademarks and co-exist without any likely confusion. DELTA faucets and DELTA airlines are another example.
