FATF publishes new guidance document In March 2024, the FATF published risk-based guidance to support the application of FATF Recommendation 25 on Beneficial Ownership and Transparency of Legal Arrangements. The document highlights the necessity for countries to assess risks associated with legal arrangements and enforce measures to ensure access to accurate and up-to-date information on beneficial owners, including settlors, trustees, protectors, beneficiaries, and those with ultimate control. Following a recent review of how principal firms are meeting its enhanced Appointed Representative (AR) rules introduced in December 2022 the FCA has determined that there is still more work to be done. Whilst the regulator found examples of good practice in many firms, there are still areas for improvement to help principal firms effectively monitor their ARs. Some firms are currently carrying out a "box-ticking" exercise around the implementation of the new rules. Firms that took part in the survey review have since all been contacted by the FCA, who has since vowed to take action if it finds principals not meeting the required standards in the future. #FCA #Appointed Representatives #Firm principals #Appointed representative rules
