What everyone should know is that the state and federal governments sets a time limit for the criminal prosecution of misdemeanor offenses. In this case, Allstate should have known that the statute of limitations for complaining about O’Neal violated the injunction orders is one year according to federal law. https://lnkd.in/ed_u9q4y. (Doc. 130). Judge Burke’s order that scheduled further criminal contempt proceedings on 04/06/2022. Doc. 147), (Doc. 148), Allstate’s motion for prosecuting criminal contempt on 10/17/2023; (Doc. 150), (Doc. 151). The District Court orders for O’Neal to answer at a hearing scheduled for 12/01/2023. O’Neal v Allstate Indemnity Insurance Company Inc. et. al. Case No. 20-cv-00743-LCB, (ND.Ala). What happened was that Allstate told the District Court that O’Neal violated the injunctions by complaining that the Medicaid program was defrauded while knowing the truth about the matter asserted according to the prior Alabama DPS and HMS administrative decisions finding no liability coverage existed for the unlicensed tortfeasor. Allstate knew that the collateral estoppel effect of the prior Alabama administrative agency decisions precluded the current criminal contempt complaint according to the United States Supreme Court on 10/17/2023. That is the malicious part. Id. How the tables turned in this case against Allstate is that the City of Huntsville used the one year statute of limitations to prevent O’Neal from obtaining a misdemeanor warrant for prosecuting the unlicensed tortfeasor for operating her unregistered vehicle without liability coverage pursuant to P.O. Charles A. Fann’s criminal complaint drafted on 11/15/2018. Id. The table turned against Allstate because O’Neal presents the federal one year statute of limitations to prevent the claim that the injunction orders were violated in the above regard. Hammarabi’s rule applies much like the principle of karma in the above regard. An eye for an eye and what goes around comes around is the case here at this juncture. Moreover, that the District Court scheduled further proceedings on 04/06/2023. Additionally, that Allstate filed its motion for criminal prosecution over one year later on 10/17/2023. Finally, that the criminal complaint should be dismissed accordingly. Id.

Attorneys Christopher Best and John Sechler published an article in Michigan Lawyers Weekly providing key insights into the recent Michigan Supreme Ruling on fraudulent claims, underscoring how the recent decision sets a precedent for honesty and integrity when it comes to insurance claims. When your insurance company becomes your contractor. People's Trust Insurance Company sues their own insureds. People's Trust Insurance Company adopts a unique approach in offering coverage to its policyholders by incorporating a repair endorsement in their policies. This endorsement obligates policyholders to utilize the services of Rapid Response Team, a contractor affiliated with the company. Interestingly, both Rapid Response Team LLC and Peoples Trust Insurance Company are owned by George Schaeffer. I am not an attorney or giving legal advice. According to Florida Statute 489, activities such as offering, negotiating, or bidding for contracting services are considered forms of contracting. As such, if these services require licensure or agent qualification, the processes of offering and negotiating must adhere to the same licensure requirements. However, Peoples Trust Insurance Company lacks the contractor licensure stipulated by FS 489. Here's how their model operates: People's Trust Insurance Company promotes and negotiates licensed contracting services via their insurance policies. Upon a claim being filed by a homeowner, Rapid Response Team, their affiliated contractor, is dispatched. People's Trust Insurance Company is responsible for adjusting the claim and negotiating the settlement of these contractor services. The claim payout is then transferred to Rapid Response Team LLC to conduct the contracted work on the homeowner's property. This movement of funds from Peoples Trust Insurance Company to Rapid Response Team, outside the oversight of the Department of Financial Services, presents issues of transparency, particularly concerning the complete utilization of funds for repairs and the integrity of the repair process. Rapid Response Team bears the responsibility of performing the contracting work and ensuring warranties for the homeowner. People's Trust Insurance Company was founded in 2008, with former Florida Insurance Commissioner Tom Gallagher serving as its Chief Operating Officer. In the story below current Florida insurance commissioner Michael Yaworsky indicated that he was going to investigate this. It will be interesting to see the outcome of the Florida Department of Financial Services investigation into the company's operations, given its connection to a former insurance commissioner. A 2022 Annual Report from the Florida Department of Financial Services’ Division of Rehabilitation and Liquidation, published in April, indicated ten insurer insolvencies since early 2021. Notable factors listed in the report contributing to these failures include "Improper management" and "Inappropriate transactions with affiliates or subsidiaries." Given these circumstances, it begs the question of whether People's' Trust Insurance Company might face a similar fate of insolvency. The company's tendency to sue its own insured homeowners further clouds its prospects for the future.

Seems to be another possible reason why Florida’s litigation stats are so high. The real red flags in this story: insurer is demanding PH’s use their co to repair. Restoration co is owned by same person who owns insurer. Seems like a system ripe for abuse, but no chance Florida regulators will ever check to make sure they’re not using this as a method to transfer assets out of the insurer. State of Florida HAD requirement for insurers to disclose payments to affiliates in the original draft of SB-7052 “The Insurer Accountability Act” but it was removed just before bill passed.
