ANTI-DUMPING DUTY UPDATE: On June 27, 2024 the US Department of Commerce completed the final determination of the AD and CVD investigation on certain pea protein from China. The Department of Commerce will upload the unpublished Federal Register notices and Decision Memoranda to the respective case files in its Antidumping and Countervailing Duty Centralized Electronic Service System (ACCESS) shortly and intends to upload the disclosure documents within five days of this announcement of the final determinations. Additionally, the ITC is still in the process of finalizing its damage determination for this product. A final determination will be announced around August 12, and once the ITC announces the damage results, the duty rate will be settled. As it currently stands, AD duties range from 111% - 280% and are retroactive from a date to be determined upon conclusions of the ITC investigation. The Counter Vailing Duty Rate announced in December ranging from 15% - 356% also applies. Importers will be responsible for both the CVD and AD.
