Thank you JoTS for picking this up. More needs to be done at the importation level to prevent this epidemic from spreading further out of control. Also, the punitive sanctions need to be much stronger to deter people away from trading in illicit tobacco products. Colleagues from across the profession often inform us that if a shop is emptied of these illicit products, they get replenished within hours. At the local level, we have enough powers: 1. Seize all the goods and equipment used in the criminality. 2. Prosecute the sellers and the controlling minds of the businesses. 3. HMRC can issue penalties and ban a business or person from selling tobacco for a fixed period. 4. LAs can close down a business for a fixed period for underage sales, ASB and repeat offending. 5. Cash can be seized by authorised AFI and police as proceeds of crime. 6. Name and shame convicted businesses and individuals. However, it’s all about resources, resources resources! We need much more resources. Many local authorities have only 1 or 2 officers to do these jobs amongst the 250 other legislation they have to enforce including many statutory functions. Newly qualified Trading Standards Officers are hardly coming through the profession. Local authorities are being stretched to critical limits. Public Health funds are also being slashed. There were talks of ringfenced central government funding for enforcement. The process of buying and registering a new car has become more convenient, as according to the new guidelines, if a vehicle owner cannot personally attend the Excise Office for registration or transfer the vehicle, they can authorize another person through an authorization letter or biometric verification, ensuring a secure and safe process. Biometric verification is also mandatory for those collecting the registration card on behalf of the owner. #CDHAlert | In today's noteworthy alert, Eugene Bester and Serisha Hariram talk about The Supreme Court of Appeal (SCA), in the recent case of Allied Steelrode (Pty) Ltd v Dreyer and Another [2023] ZASCA 181.   A loan offered as a gesture of friendship, where it is not customary for a lender to do so and where no interest is levied, cannot be said to be an arm’s length transaction as provided for in section 4 of the National Credit Act 34 of 2005 (NCA).   The Supreme Court of Appeal (SCA), in the recent case of Allied Steelrode (Pty) Ltd v Dreyer and Another [2023] ZASCA 181, confirmed this position when it set aside an order of the Gauteng Division of the High Court, Johannesburg, which had incorrectly found that such a transaction was at arm’s length under the NCA.   The SCA upheld the appeal by Allied Steelrode (Pty) Ltd, including the granting of an order as to costs.    Read more here - https://bit.ly/3tTSGxS   #disputeresolution #sca
