On 21 May 2024, Brazil’s Ministry of Finance’s Secretariat of Prizes and Betting published Ordinance SPA/MF nº 827, establishing the regulatory framework for gambling operator licensing. This Ordinance lays out the general rules for the authorization procedure, including the required documentation and applicable deadlines, marking another vital step toward the long-expected launch of the country’s regulated gambling market. According to the Ordinance, only legal entities incorporated under Brazilian law as limited liability companies or corporations with headquarters and administration in Brazil may apply for a license to operate fixed-odds betting. The authorization, valid for a five-year term, requires a payment of BRL 30 million ($5.82 million). Existing legal entities in Brazil must comply with these new regulations by 31 December 2024. Dutch Court Orders #Unibet to Reimburse Player’s Losses During Illegal Operation Period In a landmark ruling, the Dutch court has mandated Unibet to refund a client the sum of €676,000 lost between 2011 and 2021—a period during which the operator conducted business without a local license. Notably, Unibet was unlicensed in the Netherlands at the time, as the #iGaming market was yet unregulated. Despite this, the court sided with the player, given Unibet’s active engagement with Dutch #gamblers. This case echoes a previous legal battle involving #Bwin, where a plaintiff sought to recover over €200,000 lost from 2008 to 2019—a similarly unregulated era for the iGaming market. However, when the plaintiff demanded restitution on the grounds of Bwin’s illegal operations, the court ruled in favor of Bwin. A surge in lawsuits against operators who once operated illegally within various countries has been observed recently. Players are increasingly demanding compensation for past losses, posing significant challenges for operators. The adjudication of such cases in the Netherlands seems to hinge solely on judicial discretion. Judges across different regions interpret the matter differently; for instance, the judge in the Bwin case deemed the claim outdated due to the statute of limitations. Unibet attempted to leverage the same argument, but the judge in their case was not persuaded.
