This is a good overview of who might be the AHJ on a project but what about people who conduct special inspections? For new commercial construction being built under the International Building Code (IBC) the primary AHJ is likely to be the Building Official though the Fire Marshal will often work in tandem with the Building Official. It is important to recognize that any person conducting any of the IBC required special inspections (detailed in chapter 17) is acting as an agent or an extension of the Building Official and their primary responsibility and line of authority is to the Building Official and the IBC. While a special inspector is often engaged by the building owner, the special inspector's primary role is still enforcement of the building code. They are contracted THROUGH the owner but not primarily TO the owner. A special inspector is NOT just a consultant for/to the owner though the inspector might provide consultative advice. The ICC Special Inspection Manual says: "The building department checks typical details of construction against construction plans, the code and referenced standards. Special inspections are done by people experienced and knowledgeable in a specific type of construction. Special inspectors also check the details of construction against submitted plans, codes and standards. Special inspection reviews the fine detail of a few portions of the structure, while jurisdictional inspection reviews broader details within the entire structure." The Manual goes on to say that a special inspector "is also one of the last people to have a chance to have errors and/or omissions rectified prior to construction. A negligent act in special inspection could very easily have disastrous results and this degree of responsibility must not be taken lightly. Special inspectors must be personally responsible for inspections of a high standard by virtue of their in-depth knowledge of the subject." My concern is the number of people conducting inspections of firestopping that are anything but special, including some who have been repeatedly removed from projects for blatant negligence but who keep taking on firestop inspection on new projects. To me that is not negligence from lack of knowledge, that is willful negligence and the height of arrogant apathy. We continue to educate AHJs, architects, engineers and GCs and hope that these false inspectors will be weeded out.

Incoming legislation changes 🗓️ Here’s a quick update about the important upcoming legislation changes affecting fire safety compliance: ✅ 13th February 2025: AS1851 needs to be nominated on AFSS. ✅ 31st July 2025: Transition pathway changes to the qualified pathway. While originally due to change this month, the government has granted a one-year extension for the Fire Protection Accreditation Scheme transition period, providing transitional practitioners more time to complete their training for qualified accreditation. Fire Outbreak Prevention - not a strength among public (Government Premises) and private property owners/manager's in Malaysia. * The occurrence of fire breakout is frequent in Malaysia whether private or public facilities. * Notwithstanding that the occasional fire outbreak arises from sabotage, the vast majority do not. * Most fire outbreaks can be traced back to poor site management of related hazards and risks. * The cost of damage, loss of productivity, and consequent increase in insurance premiums as a result of fires must be significant. * It comes back to fire hazard awareness, and prevention measures arising from knowledge of combustion science, and typical causes of fires. * In terms of workplaces (including offices), fire awareness and prevention should be an integral part of an organisation's safe working program. * A basic understanding of the elements making up a fire (eg. oxygen availability, flammable material, ignition source), taught to employees and contractors with regular site-checks would help prevent fire outbreaks. * Common ignition sources are electrical based (faulty connections , damaged cable, lack of basic electrical maintenance). * Contractors coming onto site to effect repairs, especially oxy-cutting, welding, braising etc create high fire risk if their fire prevention standards are inadequate. * Furthermore, the control of flammable material, and its storage, is also a common weakness. * Electrical installations should be part of regular site-safety audits, and follow-up action plans. * Under the forthcoming Occupational Safety & Health (OSH) legislation amendment Act (enforcement starting on 01.06.24), the HIRARC (Hazard Identification, Risk Assessment, Risk Control) process conducted by organisational management must include fire hazards and prevention measures.
