I, along with Hunar write for the The Leaflet assessing Justice Gokhale's decision on the recent IT Rules amendment, the thrust of which was to validate the government's decision of appointing a fact-checking unit for identifying “fake, false or misleading" information on social media, and subsequently pressuring the social media intermediaries to remove such information. It was a split verdict, with Justice Patel ultimately striking down the amendment. ⏭ Despite what my facial expression might imply ;): It was a highly interesting, sometimes emotional and in any event relevant discussion I was glad to be part of. Unsurprisingly, seemingly irreconcilable views remain on the so-called #Zitierverbot. ⏭ This can only means one thing: Discussions have to continue, so that a solution can be found how to reconcile the freedom of press with the integrity of criminal proceedings - cf BGH, decision dated 27. June 2014 - 2 BvR 429/12, mn 26: ❗ The criminal provision is primarily intended to prevent parties to proceedings (...) from being affected in their impartiality by the premature publication of official documents. ❗ The bias that threatens to arise from an anticipated public discussion of official material - often combined with one-sided opinions or even evaluations directly aimed at exerting influence - and the dangers this poses for establishing the truth and for a fair judgment should be countered. In Vienna, a legal debate concerning the expiration of media privilege in data protection law and the question of whether it should be forbidden to quote from files in the pre-trial period has recently drawn attention, as reported by the Austrian daily newspaper Die Presse. The Constitutional Court's ruling mandates the cessation of this privilege by the end of June. This development prompts the need for new legislation regarding citizens' rights to request data from media outlets, while also raising concerns about balancing this with protecting journalists' sources. Notable experts such as Florian Klenk, Silvia Grünberger, Benedikt Kommenda, Maria Windhager, Nikolaus Forgó and Schoenherr counsel Oliver M. Loksa engaged in these discussions at the "Legal Panorama at the Juridicum". Loksa highlighted the importance of considering the broader impact on individuals beyond politicians, cautioning against sensationalism and potential misinterpretation of isolated chat excerpts for the sake of protecting suspects' rights but also, and especially, the integrity of criminal proceedings. #dataprotectionlaw #mediaprivilege #criminalproceeding photos: ©Mirjam Reither

On February 24, 2024, Canada introduced the Online Harms Act (Bill C-63) to Parliament. This game-changing legislation aims to protect users from harmful online content and hold online services accountable. Since its tabling in the House of Commons, there has been a steady stream of commentary and debate about what this proposed law will mean for victims of abuse, proponents of freedom of speech, impressionable young people, and marginalized groups frequently targeted by hate speech. As the Monsoon 2024 session is slated to commence on July 22, we present our Legislative Brief for MPs outlining key digital rights issues which we hope to see deliberated upon in the houses. The 17th Lok Sabha (2019-2024) was grim and chaotic with over 140 MPs suspended– a total of 221 bills were passed and 35% of these bills were passed within less than an hour (⚠️) of discussion/deliberation. Issues covered in our legislative brief include: 1️⃣The Digital Personal Data Protection Act, 2023 2️⃣The Telecommunications Bill, 2023 3️⃣The Criminal Law Reform Acts 4️⃣The Broadcasting Bill, 2023 In the upcoming session, the govt will table a new full budget in both houses for deliberation. Freedom of press is vital for resilient and healthy democracies. The Council and the Parliament have reached a provisional agreement on EU law which will protect journalists and human rights defenders against abusive court proceedings. The use of lawsuits to silence people who speak out on issues of public interest is a growing phenomenon. This EU law will put in place procedural safeguards against such claims in civil matters with cross-border implications.
