The #California legislature has ordered an audit of Cal/OSHA's enforcement efforts. Okay, but one of the "problems" cited by the Assemblymember who requested the audit is this: "In addition, four out of five of the cited employers were in the process of appealing their citations. This means that employers fined by Cal/OSHA can wait out the appeals process, pay nothing in the interim, and ultimately settle for pennies on the dollar." I've heard this complaint before, but it doesn't line up with reality. Employers appeal citations when the citations are not justified, the appeals process is litigation (not "waiting out"), and of course employers shouldn't have to pay fines while their appeal is pending. https://lnkd.in/gCFH7tRZ

This is an important topic and was a focus of the recent course I taught at GRAR titled “Ethical Issues and Current Controversies in Rental Properties.” There are pros and cons. ⚖️⚖️⚖️ I hope City Council genuinely listens to the community and thinks through all potential consequences. I tend to think that greater enforcement is a better solution than layering on more laws that might constrain supply and hinder growth. I worry that the worst landlords will find ways around these news laws like they always have with verbal leases, intimidation and constructive eviction, and/or just have less incentive to make repairs. I would instead like to see a well funded housing court that actively deters slumlords from operating unethically and disobeying fair housing laws. Similarly, such a court would deter tenants/squatters who maliciously manipulate the system and/or vandalize units. I believe that we need to enforce the current laws and study the effects of Safe Harbor and Tenant Protection before we consider opting in to Good Cause Eviction Protections.
I have asked each of my district Councilmembers to host a forum on proposed Good Cause legislation outside of city hall. We want to hear from the community on the pros and cons of introductory 251 which is held in committee. Please join us to provide your perspective!
