Put simply – an Advance Care Directive is a document that empowers an individual to make clear legal arrangements for their future health care, end of life, preferred living arrangements and other important matters, in case a time comes in their life when they can’t make their own decisions. People authorised to witness Advance Care Directives include health practitioners, Justices of the Peace, law practitioners, police officers, social workers and teachers. At the end of last week, the Office for Civil Rights updated its FAQs stemming from the #databreach at Change #Healthcare. The key is who is responsible for sending the #HIPAA mandated notice and how the responsibility can be delegated. The update responds to a pretty broad public campaign by #hospitals and other organizations to shift responsibility. What does it mean for #compliance though and what the #regulation says? Assisted Dying. I am sadly going to repeat something I put on the table on this topic in the late 90s. We need to pause this briefly and reflect, whilst societal mood has changed significantly the fundamental safeguards are still the same. Now I shall repeat. 'It is critical that any system implemented in law and of equal if not more importance in practice is a person centred with a human rights based approach. Not left to Doctors and or judges to safeguard, as that will potentially lead to lowering standards increasing risk of systemised control, nor should we weigh such towards families. It is imperative that we have an independent palliative advocacy process that can act not just as the patients advocate, but as the independent recorder of each individual process." #safeguarding #protection

If you're in North Carolina, then the answer is C if your child does not have a Health Care Power of Attorney (HCPOA). Once your child turns 18, they are an adult in the eyes of the law. And as an adult, they make their own medical decisions. But, if they become incapacitated and can't make those decisions, the authority does not revert back to Mom or Dad. It is in the hands of the doctor to decide what the best course of treatment is for your child. If you'd prefer to be involved in directing your child's care - and your child agrees - then your child should work with an estate planning professional to implement a HCPOA. #estateplanning #advancedirectives #parentalrights #healthcarepowerofattorney #healthcareproxy
