What happens when you don’t have a Health and Welfare Lasting Power of Attorney in place, and your close relative has lost mental capacity? What do you do when decisions need to be made regarding their ongoing care? For example: • You may think it’s time for them to be moving out of their home and going into residential care. • Or, perhaps you feel they would be better to remain in their own home and have a care plan in place. Whichever way forward you choose, without an LPA in place you would need to apply to the Court of Protection to be able to legally make a decision on your relative’s behalf. The Court of Protection will then decide on your relative’s mental capacity, make an order relating to their care decision, and hopefully appoint you as a deputy. The process is both timely and costly, with no guarantees, and not something you would want to be going through at an already emotional time. Having a Health and Welfare LPA in place is invaluable in times like this.
