I am sad to hear about the passing of another family member (the third in two weeks). With each death, I hoped that my relative had a Will & Testament. ❔ Did you know? Under the Property (Relationships) Act 1976 each partner in a marriage, civil union partnership or de facto arrangement is presumed to have contributed equally to the relationship. This means on separation or death there should be an equal division of assets in the relationship property pool. But what happens to trust property when a separation occurs? The Ministry of Justice estimates there are currently between 300,000 and 500,000 trusts in Aoteraoa/New Zealand. "The legislation is quite nuanced when it comes to trust property and separation," Shine's Special Counsel Clinton Light said. "There are certain instances where one party can make a legitimate claim to have a property be returned to the relationship pool even if it was owned by the other party, so it's really important to seek advice on these matters."
