Let’s make sure that the oil and gas industry is not penalized for their own efforts to detect more emissions under Subpart W. EPA’s proposed revisions to the Greenhouse Gas Reporting Program (GHGRP) rules, or Subpart W, contain several key changes including a "methane fee” or “waste methane emissions charge” that is tied to emissions. If credible information indicates that large emissions over a certain threshold were released, operators risk being penalized with increased fees. This inadvertently disincentivizes finding more emissions using the best available technology. Regulations should be structured to encourage and incentivize emissions detection and reduction, not penalize. Alternative solutions exist, like in Colorado, that flip the incentive.
