⚖ Realizing the Full Potential of ADR in Promoting Access to Justice and Fostering Economic Growth 💹 GIZ Tanzania, through the project on the Promotion of Rule of Law and Judiciary in Africa (PRoLA), collaborated with the Ministry of Constitutional and Legal Affairs (MoCLA) and Arbitral Institutions to conduct a one-day workshop themed "The Role of Alternative Dispute Resolution (ADR) in Access to Justice for Economic Growth." This workshop, held on 18 July in Dar es Salaam, brought together about 55 stakeholders from both the public and private sectors and served as a platform for exchanging and sharing best practices on how ADR can act as a catalyst for private sector development. Despite the importance of ADR in the community, most people lack a clear understanding of what ADR is, where to access these services and the role it plays in promoting access to justice. ADR offers ways for parties to settle civil disputes with the help of an independent third party and without the need for a formal court hearing or as an alternative to litigation. It involves the application of theories, procedures, and skills designed to achieve an agreement that is satisfying and acceptable to all parties in a non-adversarial manner. The importance of ADR lies in its ability to provide parties with a more efficient, cost-effective, and collaborative means of resolving disputes while preserving relationships and promoting justice. #ADR #AccessToJustice #RuleOfLaw #EconomicGrowth #GIZTanzania

From #data to action: We met with Deputy Chief Justice Richard Buteera who was handed a copy of the latest Justice Needs and Satisfaction survey in #Uganda. Published last month, this unprecedented third study for the country aims to be a catalyst for change and sets the stage for improving access to justice nationwide. Justice Buteera highlighted the significance of traditional dispute resolution methods like mediation, arbitration, and negotiation, underscoring the satisfaction people feel when such methods are used to resolve disputes. Furthermore, he expressed support for Alternative Dispute Resolution and the ADR Strategy of the Judiciary to enhance the administration of justice. Such an honor to have been given the mantle to give an overveiw of the mandate of the Ministry of Justice at this years Africa Public Service Day Celebrations that was held yesterday. Some key points i brought out are that the Ministry of Justice is a Government body that administers justice and the protection of the rule of law. This is done through litigation, prosecution, arbitration, legislative drafting and debt recovery to mention a few. To achieve its mandate we use the National Prosecution Authority, Legal Aid, The Administrator Generals Office, The Judicial Service Commission, ZIALE to mention a few. Another key point i brought out was that the Government through President Hakainde Hichilema has introduced the decentralization of the Attorney Generals Office which is now in 7 Provinces. The theme for this years Africa Public Service Day Celebrations was ''Empowering a Centric Public Service for An Inclusive and Thriving 21st Century Africa: A Journey of Lifelong Learning & Technological Transformation. Wednesdays are dedicated to bringing you insights and highlights within the ADR industry. In Q1 of 2024, we observed a massive shift towards digital ADR platforms and widespread advocacy for the adoption of ADR mechanisms across sectors globally and in Africa. This practice aims not only to broaden the scope of dispute resolution but also to increase its efficiency and accessibility. There has also been a recent increase in automatic referrals to ADR for cases which the court finds arbitrable. Here's a sneak preview of Nigeria, Uganda, and Kenya: 𝐍𝐢𝐠𝐞𝐫𝐢𝐚: In Oyo State, The Justice Development and Peace Commission in Ibadan called for the widespread adoption of a community-based strategy in conflict resolution. Trainings on ADR were conducted to assist communal and grassroots dispute resolution. Also, the Lagos State Multi-Door Courthouse educated key players in election matters about the need to resolve electoral disputes through ADR mechanisms. 𝐔𝐠𝐚𝐧𝐝𝐚: President Museveni has urged the judiciary to reassess the country's justice system, emphasizing the importance of alternative dispute resolution mechanisms for swift justice delivery. The call was conveyed by Vice President Jessica Alupo during the official opening of the 25th annual Judges' Conference in Kampala. According to the president, the existing justice system is a legacy of colonialism, and there is a need to expedite case resolution, aligning with the promptness observed in traditional African settings. 𝐊𝐞𝐧𝐲𝐚: The government approved the use of Alternative Dispute Resolution mechanisms for controversial Mwea Settlement Scheme Land Disputes. The aim is to adopt native methods of resolving disputes before resorting to the courtroom. Also, Deputy President Rigathi Gachagua urges commissioners within government bodies to use ADR instead of courtrooms to resolve intergovernmental agency disputes. In 10 days #Tanzania , supported by GIZ Tanzania and EAC, African Legal Information Institute and Laws.Africa, will host an important conference on the sustainability of public and open access to the law. We expect participants from 13 jurisdictions from southern and East Africa, the European Union, the United Kingdom, and The Netherlands. Some might say public access to legal information is a narrow issue within the rule of law sector. Looking at our participants' list for this conference, this does not seem to be the case. Besides the "usual suspects" of Ministry of Justice, Judiciary, Judicial training institutions, Attorney Generals, Prosecution Services, Law Reform Commissions, Law Societies, Law Faculties, Legal Aid and development partners, our conference will be attended by government printers, non-profits, TANZANIA CHAMBER OF COMMERCE, INDUSTRY AND AGRICULTURE, The Prevention and Combating of Corruption Bureau PCCB, Tanzania Women Chamber of Commerce (TWCC). They are all eager to participate in the discussion because they need access to legal information to do their work. Public access to the law and ensuring it is in the palm of every government official, lawyer, citizen and business owner is a foundational prerequisite of the rule of law. A functioning rule of law means a functioning government, access to justice, a functioning legal sector, and a functioning business environment. We will explore the impact of public access to the law in Tanzania and Africa at the conference, and find practical and actionable way forward to sustain Tanzania's momentum in delivering this vital public service. "ADR stands for African Disputes Resolution." 🟣This statement was made by Hon. Alfonse Chigamoy Owiny-Dollo, Chief Justice of Uganda. This was at the first ever Chief Justices' Summit on Alternative Dispute Resolution held in Kampala in March 2024. It sparked a lot of discussion. 🟣The Chief Justice argued that before colonialism, African societies resolved disputes through Arbitration, Mediation, and Conciliation. Methods that were fast, cost-effective, and based on reconciliation. 🟣He argued further that what we now call Alternative Dispute Resolution (ADR), was actually the original African way of resolving conflicts. That what we call the Tradition Justice System today was imposed on us during colonialism. And that the system has its problems. Court cases take too long. They're expensive, stressful, and often damage relationships. 🟣But not everyone agrees Some argue that the traditional systems didn’t fully protect human rights and women’s rights and often weren’t voluntary. Collaborative learning is underway! We’re excited to welcome onboard the Somali-based consortia around Security and the Rule of Law, including Media INK, Interpeace and IDLO - International Development Law Organization (who) join Propel with a focus on two programmes in Somalia and Somaliland. These are: The Damal Program with implementing partners IDLO, NAFIS Network, Legal Aid Clinic (LAC) and Media INK. Its objectives are to improve the social contract through increased legitimacy of justice sector institutions in Somaliland and the implementation of Alternative Dispute Resolution centres. The Miisaan Program with implementing partners Interpeace, Institute for Peace and Conflict Studies and Media INK. Its objective is to contribute to inclusively developed, locally informed, and widely supported transitional justice frameworks endorsed by key stakeholders in Somalia and Somaliland. Propel is the software solution that transforms the way organisations capture, access and reuse learnings to adapt, innovate and create lasting change on a global scale.
