Identify Equipment Location: Knowing the precise location of the equipment relative to the breakthrough sign is crucial. This ensures efficient access and minimizes disruptions to operations. 3. Engage with the Operator: Approach the operator responsible for the breakthrough sign. Halt their operation and request their assistance in safely opening the sign. By involving the operator, you ensure compliance with safety protocols and authorized access. 4. Commence Work: With the breakthrough sign open, proceed with the job as planned. There is a shred of hope that perpetrators of “safety crimes” will be held accountable for their reckless actions. Of course, let me remind you that there are profound safety issues MSHA is allegedly willing to ignore: 1. Less than 1% of miners receive hydraulic safety training. 2. Over 85% cannot pass a competency test in fundamental hydraulics. This applies to sub-contractors as well as miners.
“Like every miner, Darren Miller had the right to go home at the end of the day, but Anthony Valente’s reckless actions denied him that opportunity,” said Assistant Secretary for Mine Safety and Health Chris Williamson. “MSHA remains committed to ensuring a safe and healthy workplace for miners, and will continue to use every tool available to us as we work with states to keep miners safe.”

MSHA Issues Final Rule for Written Safety Programs The U.S. Mine Safety and Health Administration (MSHA) published a final rule that requires mine operators to have written safety programs for surface mobile equipment, excluding belt conveyors, at surface mines and the surface areas of underground mines. The agency requires that mine operators develop programs, implement them, and update them when necessary. The written safety program must be developed and updated with input from miners and their representatives.
