Evan Fried and Ted Farrell these interviews are great. Anyone interested in the litigation funding ecosphere keen to work out the gentlemen and the players, the good, the bad and the ugly, should watch these and any future episodes. Particular highlights for me included: -the discussion on whether cost of funding could/would/should be passed to the losing party; -increasing role of insurance in the US; -role/inpact/use of advertising and marketing over social media -capped returns to funders -increased need for litigation funding consultants to help law firms manage their funding and understand the bespoke options available to them I’d love to see future episodes covering: -role/function/use of regulation of funders -funder returns- oversight -hidden conflicts in the ecosystem and how they are managed -penalties for rogue behaviour - plaintiff lawyers, defendant lawyers, funders and capital providers -lessons learnt-UK/US/Australia/Canada -spotlight on the view from the multi strat/distressed debt/special sits fund vs the view from the coal face in the court room. #litigationfinance #thirdpartyfunding #feesplitting #costofcapital #plaintifflawyers #masstorts #rogueactors #smartmoney #sophisticatedplayers

Regulation or Litigation? In Europe we often pride ourselves that we regulate things rather than turning to litigation. Is regulation more effective than litigation, if the chances of getting penalties for non-compliance are so slim as is often the case in Europe? Is the pro-active approach better than the reactive approach?

N&T’s Dispute Resolution Group assessed the issue of interim measures and their ordering and the potential consequences of their order at its last meeting, in particular the Group discussed the interim measure prior to the initiation of proceedings. The discussion of this topic was justified by multiple successful applications for interim measures in the context of an ongoing litigation, where the different procedural practices and decisions of different courts were also disputed by the members of the Group. #interimmeasures #litigation #courtpractices

The biggest advantage, we feel, is that litigation funding provides access to justice to many individuals and SMEs who would not otherwise have the means to bring costly litigation, particularly when faced with a well financed defendant. https://lnkd.in/ecUyS7Eb
