The shift to remote and hybrid work models is reshaping the tax compliance landscape under Pillar Two, challenging traditional tax planning methods. Companies must now integrate the realities of workforce mobility into their tax strategies to address the complexities introduced by BEPS. As the nature of cross-border work transforms, driven by the demand for greater work flexibility, global businesses face new tax hurdles. The EY 2023 Work Reimagined Survey reveals that 50% of knowledge workers favor working from the office no more than one day per week. Furthermore, the EY 2024 Mobility Reimagined Survey reports a dramatic rise in the tracking of employee movements by employers, with a jump from 49% to 98% in just one year. This trend towards flexible working arrangements, coupled with increased monitoring of where employees work, brings to light potential tax issues as the OECD's Pillar Two global minimum tax project progresses. Disparities between employees' payroll locations and their actual work locations could result in unforeseen tax liabilities and the risk of establishing a permanent establishment. The importance of workforce mobility in organizational talent strategies is growing, not only due to the flexible work paradigm but also because of the global race for talent, making it a pivotal tax issue. It presents both risks and opportunities: while it introduces tax risks and compliance demands, it also allows for the reevaluation of operating models and the potential to leverage tax incentives. The “next normal” of cross-border work is reshaping tax compliance for global financial services firms, particularly in payroll taxes. The EY 2023 Work Reimagined Survey highlights that 50% of knowledge workers prefer working one day or less per week in the office, while the EY 2024 Mobility Reimagined Survey shows that 98% of employers now track employee movements domestically and internationally. This shift toward flexible work arrangements introduces some challenges as governments implement the OECD’s Pillar Two global minimum tax project. Payroll taxes are typically deducted based on where employees reside or work, not where they are paid. This discrepancy means that if employees establish a presence in a jurisdiction unknown to the company, it could expose the business to unexpected taxes and create a permanent establishment for tax purposes. To mitigate these risks, FIs must adopt rigorous documentation practices for their workforce’s locations or leverage new tech to track and govern employee presence.
