https://lnkd.in/eX_vmkjW I’m happy to see that the #courtofappeal has quashed the #criminal #conviction entirely and refused to order a #retrial in the case of R v Auriol Grey [2024] EWCA Crim 487 (https://lnkd.in/eKMCps9A). As Dame Victoria Sharp, President of the King’s Bench Division, observed at [21-25]: It is common ground that the appellant could only be convicted of #manslaughter if she had committed the #offence of common assault, this being the only possible base offence. It is also common ground that the elements of the base offence were never specified at #trial, whether by the #prosecution or by the #judge, nor was the failure to do so recognised by those then representing the appellant. This was not simply a failure to provide a label for a base offence about which the #jury were otherwise properly directed. The #jury were provided with no directions at all about any of the elements of the base offence, whether relating to the actus reus or the mens rea. They were simply not asked to consider the factual elements required to prove a common assault. This amounted to a failure to direct the jury about an essential ingredient of the offence of manslaughter. before concluding at [36] that: In all the circumstances, we have no hesitation in concluding that the appellant's conviction for manslaughter is unsafe….There was, in our judgment, simply no proper basis for the #appellant to be convicted of manslaughter in this very tragic case. This case should be included in a cycling awareness campaign to emphasise to #CYCLISTS that pavements are NOT to be used for pushbikes for reasons that should be readily apparent. As for Crown Prosecution Service, I’m amazed that nobody bothered - in the first place - to consider the #legal soundness of the #indictment being brought before taking it to trial at #crowncourt. It’s thoroughly unsatisfactory for the Crown Prosecution Service to try to force Simon Spence KC FRSA DipABRSM to mop up - in the #courtofappeal - a flimsy prosecution long after the ship has sailed.
