A year working in Italy sounds dreamy, and with a visa like this on offer, employers are hard pushed to refuse. However, not only does Andy make a great point below around permanent establishment, tax, social security and payroll risk, but employers need to look at the downstream effects on their #employeebenefits programmes. Yes, there is a requirement for individuals to take out medical insurance (and employers can choose not to fund this), but employers should also look at other parts of their benefits - it's not unknown for life insurance to become invalid for long absences out of the country of employment. Rights to contribute to pensions may also fall out for longer periods, eg if breaking tax residence. Such risks can be mitigated (through #expatpolicies, for example), but puts cost and admin burden on employers unless they adequately indemnify themselves. Let me know if you'd like to discuss! (I should note that this is not an Italy-specific issue - but Italy is the latest country to offer a #digitalnomadvisa, and it got me thinking about a nice Aperol spritz sitting on a piazza...)
Interesting announcement from the Italian government. What is not mentioned in the article is what obligations this will place on employers from a payroll perspective, nor the implications for potentially creating a permanent establishment. When considering these initiatives, a thorough understanding on the part of both the employer and employee of all aspects of the arrangement (of which tax is just one) is critical. https://lnkd.in/egzkYb32

I’ve been thinking a lot about this article in the last couple of days, as I’ve seen responses from my friends in the orchestra world. As a career advisor to emerging performers hoping for a full-time career as orchestra musicians, my dilemma is not knowing how to educate my students to protect themselves and how to advocate for others who have been harmed in the workplace. How can I in good conscience advise young women to sub in an orchestra— even one as prestigious as NYP— when they can be assaulted by a union-backed member and then ignored? How can music schools like my institution, Indiana University Jacobs School of Music , join this conversation and support our students hoping to work in this environment?
This…. So many layered horrors in this story, least of them is the broken system of personnel management that is an accepted norm of orchestra HR. This has to be fixed - unions must lead or nothing with happen.

The Center for Music Ecosystems, 4AArts, and Whippoorwill Arts jointly released "Recommendations for Live Performance Pay & Professional Protections for Working Musicians". This project represents over two years of dedicated effort, including a national survey titled "Turn Up the Mic, Tune Up the Future" conducted by Slover Linett. The Recommendations aim to establish fair pay scales, introduce creative solutions, and create a more just music ecosystem. They stress the importance of hourly pay for musicians, professional protections, expense considerations, and the provision of sustainable work opportunities. This document is designed to be a living tool, evolving through feedback and input from the community. Whippoorwill Arts is part of a growing coalition committed to ethical pay and professional protections in the arts. They are eager to hear thoughts and feedback on these Recommendations. 🤔 Do you engage sole traders? What about musicians, performers, or entertainers? 🎵 🎙 🎨 🏅 Are you aware that contractors can be considered "employees" for superannuation purposes... even when they are running a completely separate, independent business? The ATO has recently issued draft Taxation Ruling (TR 2023/4DC1). This is an update to TR 2023/4 and updates the guidance on the extended meaning of an “employee” under sections 12(2) to 12(11) SGAA. It's important for everyone to be across the ATO's position, but particularly anyone that engages contractors for their labour, or entertainers, artists, musicians, sportspersons, promoters (and similar). Penalties for non-compliance are high and there is no limit to the historical review period. Please contact A&M if you want to discuss the draft TR and changes that you may need to make to your processes (such as contractor on-boarding and review) to manage SG obligations correctly. #superannuation #contractors
