Please join us at our London (City) office on Wednesday 25 September for a timely and insightful seminar in which we'll discuss how we mounted a successful defence to a health and safety at work prosecution brought by the MCA, arising out of a fatality. John Caddies, head of our PI, Travel and Regulatory team, and regulatory defence lawyer Stephen Barnfield, will lead the session, joined by Mark Balysz KC of Crown Court Chambers. Discussion will include the roles of the police, the HSE, MCA, MAIB and flag state, corporate manslaughter and MCA/HSE fines in the context of the incident, and the process of the litigation. Ships are detained by Port State Control under the ISM Code to ensure that they are operating safely and in compliance with international safety standards. Detention serves as a means to enforce compliance, protect the safety of those on board, and prevent accidents at sea. #SafetyFirst #Safety #Maritime #Marine #AsOneweCan #Seafarers In response to deficiencies identified in fire safety and security management systems (FSMS) during 2023 Port State Control (PSC) examinations, the report recommends a series of corrective actions, including: Enhanced Maintenance and Repair: Ensuring proper maintenance and timely repair of fire safety and security equipment is critical. Strengthened Crew Training and Awareness: Regular drills and training programs are essential to equip crew with the knowledge and skills to respond effectively to fire and security emergencies. Rigorous Inspection Regimes: Frequent and documented inspections of fire safety and security systems are necessary to identify and rectify potential issues before they escalate. Strict Adherence to SMS Requirements: Compliance with the International Safety Management (ISM) Code and company-specific Security Management System (SMS) is paramount for effective risk management. Investment in Technical Upgrades: Modernization of fire detection and alarm systems, security cameras, and other relevant equipment can significantly enhance onboard safety and security. Proactive Risk Assessment and Mitigation: Implementing a proactive approach to identify and mitigate potential fire and security risks is crucial for preventing incidents. Prompt Reporting of Issues: Immediate reporting of any identified deficiencies in fire safety or security systems allows for timely rectification and reduces the likelihood of detentions during PSC inspections. https://lnkd.in/e_Zsf9uC

Every glance becomes a battlefield, where emotions clash and understanding feels just out of reach. What is Maritime Safety? Maritime safety is the protection of the crew and passengers aboard vessels, as well as those living or working near bodies of water, from hazards and the risk of injury or fatality. An example of maritime safety according to the Occupational Safety and Health Administration (OSHA) is the provision of Personal Flotation Devices (PFDs), which aid in the recovery of Persons In Water (PIWs) who are at risk of hypothermia, drowning, and even death. #safetyfirst #proinde

A timely reminder of the risks and threats that abound in our work environment.
Port Skills and Safety Ltd has been saddened to hear of two separate fatal accidents having occurred in two different UK ports this month. We send our condolences to the families and colleagues of the deceased. To learn of two fatal incidents within weeks of each other is shocking and we will be working with all those involved to understand the root causes of both accidents and take whatever steps may be needed to learn the lessons of both to avoid any repetition in future. https://lnkd.in/eXjmJAdG
