Yesterday, the NFL Players Association filed a lawsuit against DraftKings in the Southern District of New York. I spoke with DBR about the case: While many of the financial details in the complaint are redacted, one section of the complaint notes the compensation of five DraftKings executives, lists their pay, and says that total compensation across these executives amounts to “approximately quadruple,” or around $65 million, of what the American gambling company allegedly owes to the plaintiffs, said Kevin C. Paule of Hill Ward Henderson in Tampa, who is not involved in the matter. “Following those clues, it seems like they’ve at least hinted at their position on how much they believe is owed and outstanding,” Paule said, “which is obviously a rather significant amount of money for a licensing deal.” The plaintiffs alleged that DraftKings is liable for all remaining guaranteed minimum payments specified by the contract, as New York law permits non-repudiating parties to immediately claim damages for a total breach while relieving them of future performance.
