An Cliquet, Alexandra Aragão, Hendrik Schoukens, Kris Decleer and I published an article on the legislative process of the - by now infamous - Nature Restoration Law Proposal. We analysed the latest compromise text and established that the law still provides an appropriate legal basis for upscaling restoration within the EU. However, the initial law proposal has also been weakened on some vital points, making it uncertain whether the final law will produce the tangible effects that are necessary in the coming years. What is the purpose of laws and the judicial system? According to the Cornell Law School and the Legal Imformation Institute , In legal philosophy, natural law is a set of universal truths, principles, and rules that properly govern moral human conduct. In contrast to positive law, natural law is pre-existing and discovered through human reason and rational analysis. From a natural law perspective, the purpose of laws and the judicial system is to become as close to natural law as possible. Positive law refers to legal rules enacted by people in a political community or governing body. It includes constitutions, statutes and regulations. Are we, as humans, too slanted towards positive law which can be changed and morphed for ideological biases? Are we being pulled too far from natural law? Are we treating our connections with earth with reckless abandonment through our behaviors that are so desperate from natural law? We are organic beings that are part of this living planet after all.
