Biden Administration Takes Action to Protect Consumers and Businesses from De Minimis Abuse • The Biden-Harris Administration announced new actions to address the increased abuse of the de minimis exemption, particularly by China-founded e-commerce platforms. • The surge in de minimis shipments, which now exceed one billion annually, poses challenges in enforcing trade laws, health and safety requirements, and intellectual property rights. • The Administration intends to issue new regulations to exclude certain products from the de minimis exemption, including those subject to tariffs or trade enforcement actions. • Additional measures aim to improve accountability and enforcement by requiring more detailed information for de minimis shipments and strengthening consumer product safety regulations. • The Administration calls on Congress to pass comprehensive de minimis reform legislation to further protect American consumers, workers, and businesses. https://lnkd.in/gFhTK__y

New Rulemaking to Reduce De Minimis Volume and Strengthen Trade Enforcement: The Biden Administration is taking decisive action to protect American businesses and consumers by addressing the misuse of the de minimis exemption, which allows low-value shipments (under $800) to enter the U.S. duty-free. This loophole has been heavily exploited by Chinese e-commerce giants like Shein and Temu, flooding the market with cheap goods and bypassing tariffs. Key measures include: -New Rule Proposal: Banning tariffed products from qualifying for the de minimis exemption. -Enhanced Data Requirements: Mandating detailed shipment information to better track and block unsafe or unfairly traded products. -Legislative Push: Encouraging Congress to pass comprehensive reforms to close this loophole.
