The discrepancy between patent invalidity standards, as applied to utility and design patents, has led to a rare grant of en-banc hearing on the issue by the Federal Circuit court of appeal. Since 2007, design patent invalidity has been evaluated under the KSR standard. However, the Federal Circuit has not yet extended this standard to invalidity analysis of design patents. The new HLK #UPC Unpacked series has been launched. The series provides insights to help you navigate and make sense of the UPC as decisions start to emerge. In this issue, we have: - a deep dive article from me on the Court of Appeal's decision on 10X Genomics' application for a preliminary injunction; - a cautionary tale from Matthew Howell about opting out; and - a video from Greg Ward about the bifurcation of proceedings at the UPC. On a personal note, I've been following the 10X Genomics cases with keen interest as the technology brought me back to one of my earliest research studies back when I worked in a lab: visualizing chromosome aberrations using multiplex fluorescence in situ hybridization (M-FISH) in blood samples from military workers who carried atomic weapons. #UPC #lifesciences #patent
