The defendant, Heather Warman, has been found guilty of operating a commercial business on Grayson Lake, which is federal property owned by the United States Army Corps of Engineers (USACE), without the required commercial business license. Despite being advised multiple times by USACE Project and Resource Manager Francis Jeffrey, Warman failed to apply for the necessary permit or cease her operations on the lake. As a result, she was issued a notice for violating 36 C.F.R. § 327.18(a). It is important for all outfitters, guides, concessionaires, and permittees to be aware of and comply with the regulations governing the use of federal property, including the requirement to obtain the appropriate permits for commercial activities. Failure to do so can result in legal consequences, as demonstrated in this case. I recently evaluated data available on USASpending, and found there to be very few sole source awards given to SDVOSBs and VOSBs. If this bill becomes law, it will be quite beneficial to SBA Certified VOSBs. Koprince states, “Section 861 would create a sole source authority much closer to that available under the 8(a) Program, which omits a “rule of two” requirement. Unsurprisingly, information available on the SBA’s Data HUB shows that 8(a) sole source awards far outstrip sole source awards under socioeconomic programs containing a “rule of two” requirement. (And the VA, which is the only agency permitted to award SDVOSB sole source contracts without a “rule of two” restriction, awards more SDVOSB sole source contracts than all other agencies combined).”

Spanish shipbuilder Navantia in exclusive talks to buy Harland & Wolff Spanish shipbuilding firm Navantia, S.A., S.M.E is in exclusive negotiations to buy Harland & Wolff, in a deal that could rescue up to 1,000 jobs. It is understood the group could take control of the group’s four yards – in Belfast; Appledore, Devon; Arnish on the Isle of Lewis; and Methil, Fife – as early as next month. A deal is not expected to involve a pre-pack administration of the operating companies that run the yards, which could put jobs at risk. At present, only the main holding company is in administration. The “Backwards Law” refers to a concept where striving for a positive experience is in itself a negative experience, and accepting a negative experience is a positive experience. This idea is illustrated in Navy SEAL training during an exercise called “drown-proofing,” where cadets must survive in a pool with their hands and legs bound. This concept is also metaphorically applied to life, suggesting that by letting go of the intense desire for control, one can achieve better outcomes. The “Backwards Law” can be applied in military contexts in several ways: 1. Training: The “Backwards Law” is used in Navy SEAL training during an exercise called “drown-proofing”. The more a cadet struggles to stay afloat, the more likely they are to sink. The trick is to let oneself sink and then push off the bottom of the pool to resurface for air. This exercise tests the cadet’s emotional self-control in extreme situations. 2. Strategy: In military strategy, sometimes the most direct approach is not the most effective. For example, a frontal assault might seem like the most straightforward way to defeat an enemy, but it could also lead to heavy casualties. A more indirect approach, such as flanking or diversionary tactics, might be more effective. 3. Psychological Warfare: The “Backwards Law” can also apply to psychological warfare. Trying too hard to demoralize the enemy could backfire and strengthen their resolve. On the other hand, showing respect and fair treatment to prisoners of war can sometimes undermine enemy morale. 4. Resource Management: In resource management, striving for efficiency can sometimes lead to inefficiency. For example, over-optimizing for cost savings in equipment procurement can lead to purchasing low-quality equipment that fails when it’s needed most. 5. Counterintuitive Survival: The more you struggle to stay afloat, the more likely you are to sink. The trick is to let yourself sink and then push off the bottom of the pool to resurface for air. 6. Emotional Control: Panicking consumes more oxygen, increasing the risk of drowning. The exercise tests the cadet’s emotional self-control in extreme situations. 7. Letting Go: The ability to let go of control when it’s most desired is a crucial skill, not just for SEAL training, but for life in general. Remember, the “Backwards Law” is not a military regulation or policy but rather a philosophical approach to challenges and desires. It’s about understanding that sometimes, trying too hard to achieve a certain outcome can prevent you from achieving it.
