Today, Holtec International filed a lawsuit against accounting firm CBIZ Inc., its subsidiary auditing firm CBIZ MHM, CBIZ executive Lonnie Davis, who operated out of CBIZ’s office in Plymouth Meeting, PA, and former Holtec executives Robert Galvin of Farmington, Connecticut and Andrew Ryan of Camden County, New Jersey, for alleged fraud linked to the formation of a rogue self-dealing operation called CBIZ Consulting LLC. The suit alleges that CBIZ Consulting was designed to fraudulently bill and collect hundreds of thousands of dollars from Holtec by using a deceptively similarly name to CBIZ. The complaint alleges egregious business misconduct including fraud, breach of fiduciary duty, breach of contract, civil conspiracy, and accounting malpractice against the CBIZ defendants and the two former Holtec executives. The suit further alleges that CBIZ is believed to have learned of CBIZ Consulting but chose to conceal its findings from Holtec. CBIZ MHM, a financial auditing firm, failed to uncover or notify Holtec of the similarly named but fraudulent company, according to the filing. The lawsuit states that the Defendants collectively caused Plaintiffs over $70 million in damage.
“As we allege in our complaint, we should have been able to trust and rely on our accounting and auditing firm, but they led us in a direction that caused significant financial harm to the business,” said Kelly Trice, President of Holtec International. “We are committed to pursuing justice and ensuring accountability of CBIZ and former Holtec employees involved in this egregious misconduct.”
